<h3 class="wp-block-heading">Kako se to odražava na Srbiju?</h3>



<p>Važno je napomenuti da direktiva postavlja minimalne zahteve kada su u pitanju zakonske mere, što znači da države članice imaju pravo da postavljaju više standarde od onih utvrđenih direktivom.<span class="footnote_referrer"><a role="button" tabindex="0" onclick="footnote_moveToReference_1832_1('footnote_plugin_reference_1832_1_7');" onkeypress="footnote_moveToReference_1832_1('footnote_plugin_reference_1832_1_7');" ><sup id="footnote_plugin_tooltip_1832_1_7" class="footnote_plugin_tooltip_text">[7]</sup></a><span id="footnote_plugin_tooltip_text_1832_1_7" class="footnote_tooltip">EUR-Lex (2018). Takođe, naš Zakon o radu već prepoznaje mogućnost da otac deteta odsustvuje sa rada , kako za potrebe nege, tako i u izuzetnim slučajevima propisanim zakonom. Dakle, usklađivanje sa pravom EU, bilo da se dešava u pretpristupnoj fazi ili u momentu članstva, neće ni na koji način smanjiti beneficije koje imaju za cilj podršku rađanju, već će se pre svega odnositi na obavezno očinsko odsustvo, negovatelje, kao i na rad sa nepunim radnim vremenom.</p>



<h3 class="wp-block-heading"><strong>Pozadina priče</strong></h3>

<p>Kako to obično biva, predlog Komisije je ublažen tokom međudržavnih pregovora u Savetu EU i krajnji proizvod ne sadrži neke od najambicioznijih odredbi. Naime, direktiva sadrži odredbu o odsustvu negovatelja (najmanje pet dana odsustva godišnje), ali za razliku od prvobitnog predloga, ne zahteva od država članica da nadoknade zaradu onih koji odsustvuju radi pružanja nege. Kada je reč o roditeljskom odsustvu, nova direktiva produžava minimalni period roditeljskog odsustva koji se ne može prebaciti sa jednog roditelja na drugog, sa jednog na dva meseca, međutim, Komisija je zahtevala četiri meseca. Konačno, iako se Direktivom o ravnoteži između poslovnog i privatnog života roditelja i negovatelja proširuje pravo na traženje fleksibilnih radnih uslova na sve zaposlene roditelje sa decom do osam godina, kao i na negovatelje, ovo nije zakonska obaveza koja se mora izvršiti. <p>Dakle, iako ova direktiva predstavlja pozitivan pomak u poboljšanju ravnoteže između posla i privatnog života Evropljana i doprinosi postizanju šireg cilja rodne ravnopravnosti promovisanjem učešća žena na tržištu rada, ona samo propisuje minimalne standarde i ostavlja državama članicama značajnu slobodu u njihovom primenjivanju. U slučaju Srbije, to znači da će usvajanje evropskih pravila u ovoj oblasti imati samo dodatne pozitivne efekte.</p>

<p>Na iznenađenje mnogih, Direktiva je po usvajanju u velikoj meri odražavala predlog&nbsp;<em>BEUC</em>. <p>U tom smislu, uspešno lobiranje&nbsp;<em>BEUC</em>&nbsp;u vezi s Direktivom o potrošačkim pravima predstavlja veliko dostignuće i „pobedu“ za evropske potrošače. Snaga ove organizacije može se pripisati raznim faktorima, ali ono što je bez sumnje igralo značajnu ulogu jeste finansiranje koje je&nbsp;<em>BEUC</em>&nbsp;dobila kroz grantove EU (1,3 miliona evra godišnje u periodu između 2008. i 2012. godine).<span class="footnote_referrer"><a role="button" tabindex="0" onclick="footnote_moveToReference_1847_3('footnote_plugin_reference_1847_3_11');" onkeypress="footnote_moveToReference_1847_3('footnote_plugin_reference_1847_3_11');" ><sup id="footnote_plugin_tooltip_1847_3_11" class="footnote_plugin_tooltip_text">[11]</sup></a><span id="footnote_plugin_tooltip_text_1847_3_11" class="footnote_tooltip">Van Dijk Management Consultants and ICF GHK (2013).&nbsp;<em>Evaluation of EU financial contributions to EU-level consumer organizations (BEUC) – 2007-11</em>. <p>Usvajanjem ovakve Direktive, pokazalo se zaista mogućim da u odlučivanju na nivou EU prevlada javni, a ne privatni interes. Nažalost, gotovo je nemoguće zamisliti da u Srbiji organizacija koja zastupa interese potrošača poseduje takvu snagu i vrši jednako značajan uticaj na domaće donosioce odluka. Ipak, s obzirom na trenutni položaj srpskih potrošača, takav scenario je preko potreban.</p>



<p>U Srbiji je unutar procesa pravne harmonizacije sa&nbsp;<em>acquis communautaire&nbsp;</em>doneto nekoliko zakona kojima se štite potrošači. Oni uvode pravila zaštite potrošača po ugledu na evropsko zakonodavstvo, ali ta pravila u praksi nisu uvek efektivna.<span class="footnote_referrer"><a role="button" tabindex="0" onclick="footnote_moveToReference_1847_3('footnote_plugin_reference_1847_3_14');" onkeypress="footnote_moveToReference_1847_3('footnote_plugin_reference_1847_3_14');" ><sup id="footnote_plugin_tooltip_1847_3_14" class="footnote_plugin_tooltip_text">[14]</sup></a><span id="footnote_plugin_tooltip_text_1847_3_14" class="footnote_tooltip">rotić, D. Najčešći problemi sa kojima se potrošači suočavaju odnose se na izostanak volje trgovaca da postupe po reklamacijama na robu ili uslugu. Takođe su česte nepoštene poslovne prakse i nepravične ugovorne odredbe, kao i kršenja obaveza trgovaca koji su pružaoci usluga od opšteg ekonomskog značaja.</p>



<p>Kada je reč o sudskoj zaštiti prava potrošača, sudski postupak je relativno dug, pravno nepredvidljiv i skup, a vansudsko rešavanje sporova se primenjuje izuzetno retko.<span class="footnote_referrer"><a role="button" tabindex="0" onclick="footnote_moveToReference_1847_3('footnote_plugin_reference_1847_3_15');" onkeypress="footnote_moveToReference_1847_3('footnote_plugin_reference_1847_3_15');" ><sup id="footnote_plugin_tooltip_1847_3_15" class="footnote_plugin_tooltip_text">[15]</sup></a><span id="footnote_plugin_tooltip_text_1847_3_15" class="footnote_tooltip">Ibid. </span></span><script type="text/javascript"> jQuery('#footnote_plugin_tooltip_1847_3_15').tooltip({ tip: '#footnote_plugin_tooltip_text_1847_3_15', tipClass: 'footnote_tooltip', effect: 'fade', predelay: 0, fadeInSpeed: 200, delay: 400, fadeOutSpeed: 200, position: 'top center', relative: true, offset: [-7, 0], });</script>&nbsp;Za razliku od gorepomenutog evropskog primera, zbog nedostatka adekvatnih stručnih i tehničkih resursa, u Srbiji ne postoji dovoljno jaka potrošačka organizacija ili koalicija koja bi mogla da pruži pravnu pomoć i podršku potrošačima, iako se nekoliko njih ističe. Dodatno, postojeći model finansiranja ovih organizacija iz javnih sredstava jedan je od najznačajnijih faktora stagnacije u širenju potrošačkih organizacija, jer obezbeđuje samo minimum sredstava za funkcionisanje ograničenog broja organizacija. Kao jedan od potencijalnih finansijskih izvora za njihov rad jeste budžet jedinica lokalne samouprave. Međutim, iako lokalnoj samoupravi treba da bude u interesu da pruža tematski orijentisanu podršku u oblasti zaštite potrošača, naročito u vezi sa pružanjem komunalnih usluga, takva podrška je u proteklom periodu bila gotovo neprimetna. Jedinice lokalne samouprave ne samo da propisuju uslove pružanja komunalnih usluga, već su i osnivači i vrše nadzor nad radom javnih komunalnih preduzeća, a upravo se u toj oblasti javlja veliki broj potrošačkih prigovora, kao i postupaka prinudne naplate u komunalnim predmetima. <p>Prema tome, problem zaštite prava potrošača u Srbiji nije toliko pravni okvir, već mehanizmi koji obezbeđuju njegovu primenu u praksi. Treba, naravno, izbeći nekoliko klasičnih zamki koje su ponekad odlikovale slična tela u Srbiji u poslednjih 20 godina – nemogućnost da sankcionišu uočene nepravilnosti, nedostatak ovlašćenja da efikasno istražuju povrede, budžetska ograničenja i zavisnost od Vlade… A prilika da se sve ovo uradi je upravo sada, u prvih 100 dana od formiranja Vlade.</p>
